TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) are between Turquoise Escapes LLC (“Agency”) and you (“you,” “your,” or “Traveler”), including all travelers on the same booking. These Terms become effective upon your electronic or written signature or payment authorization and remain in effect unless terminated in writing by you or Agency.

Agency reserves the right to update these Terms at any time without prior notice.

DEFINITIONS

Agency means Turquoise Escapes LLC.

Booking Services means travel advisory, reservation, and booking services provided by Agency.

Lead Traveler means the individual acting on behalf of all travelers on the same booking.

Supplier means any third party providing travel products or services.

Travel Services means travel-related products and services provided by Suppliers, including accommodations, transportation, tours, activities, and related services.

TRAVELERS AND AUTHORIZATION

By signing or authorizing payment, you agree to these Terms on behalf of yourself and all travelers on the same booking. You represent that you have shared these Terms with all travelers and obtained their consent.

You are responsible for timely booking, confirmation, and payment of travel arrangements and for reviewing these Terms prior to engaging Agency’s services.

ROLE OF AGENCY AND SUPPLIERS

Agency acts solely as a travel advisor and booking agent and does not provide Travel Services. All Travel Services are provided by independent Suppliers operating under their own terms and conditions.

Agency is not responsible for Supplier actions, omissions, financial solvency, or failure to perform services. Supplier policies govern all bookings, refunds, cancellations, and penalties.

RATES, INCLUSIONS, AND PRICING

Quoted rates are based on specific inclusions confirmed in writing. Additional fees, taxes, and personal expenses are not included unless explicitly stated.

Supplier pricing, currency fluctuations, and availability are subject to change without notice.

PAYMENTS, CHANGES, AND CANCELLATIONS

Traveler authorizes Agency to process payments for Booking Services and Travel Services. Failure to make timely payments may result in cancellation and penalties.

Changes and cancellations are subject to Agency fees and Supplier penalties. Refunds are governed by Supplier policies.

SERVICE FEES

Service fees are separate from the cost of travel and are earned upon commencement of services. Unless otherwise stated in writing, service fees are non-refundable and are not contingent upon Supplier performance, guest participation, or completion of travel.

DESTINATION WEDDINGS AND GROUP EVENTS

Agency provides travel advisory services related to destination weddings and group events. Agency does not act as a wedding planner, event coordinator, or vendor and is not responsible for the planning, execution, or outcome of any wedding ceremony, reception, or related events.

All wedding services, ceremony details, décor, vendors, timelines, and on-site coordination are provided solely by the resort, venue, or third-party Suppliers. Agency’s role is limited to travel planning and liaison support as outlined in the applicable service fee agreement.

Agency does not guarantee wedding package inclusions, group benefits, minimum room night fulfillment, guest participation, vendor availability, weather conditions, or event outcomes. Supplier policies, pricing, and inclusions may change without notice.

Each guest is responsible for their own travel arrangements and compliance with Supplier policies. Agency is not responsible for guest cancellations, payment defaults, or changes in participation that may affect group benefits or wedding-related incentives.

Destination wedding service fees are earned upon commencement of services and are non-refundable, regardless of wedding completion, guest participation, or Supplier performance.

TRAVEL INSURANCE

Agency strongly recommends comprehensive travel insurance. Travelers assume all financial risk if insurance is declined.

LIMITATION OF LIABILITY

Agency acts solely as an intermediary between Travelers and Suppliers and has no control over Supplier services or Traveler conduct.

To the fullest extent permitted by law, Agency is not liable for any direct or indirect losses, damages, injuries, or claims arising from Supplier actions, Traveler conduct, third-party acts, or events beyond Agency’s control.

If Agency is found liable despite the foregoing, liability shall be limited to the amount of service fees or commissions received by Agency.

FORCE MAJEURE

Agency is not responsible for delays, cancellations, or losses caused by events beyond its control, including natural disasters, pandemics, government actions, or Supplier failures.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of California. Disputes shall be resolved through good-faith negotiation and, if necessary, binding arbitration.

ENTIRE AGREEMENT

These Terms, together with any applicable service fee agreement, constitute the entire agreement between Traveler and Agency.

SELLER OF TRAVEL CREDENTIALS

Turquoise Escapes LLC is an independent agency authorized to operate under Legato.
